The arbitration shall take place in Tulare County, California, unless you and we agree to a different location or to conduct the arbitration by telephone or video conference.

11.3 Class Action Waiver

YOU AND HOME HELPERS GROUP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

11.4 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court’s jurisdiction. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

12. Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Tulare County, California.
